Terms of service for HiDream AI

Introduction and Acceptance of Terms

Welcome to HiDream AI, an AI-powered image generation platform. By accessing or using our service, you agree to be bound by these Terms of Service. If you do not agree with any of these terms, please do not use our service.

Use of the Service

HiDream AI provides users with an AI-powered image generation platform. You agree to use the service in accordance with all applicable local, state, national, and international laws and regulations.

User Accounts and Registration

  1. Account Creation: To access certain features of the service, you need to create an account. You must provide accurate and complete information during the registration process.

  2. Account Security: You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account.

  3. User Responsibilities: You agree to notify us immediately of any unauthorized use of your account or any other breach of security.

Content and Intellectual Property Rights

All content provided through HiDream AI, including but not limited to templates, code, infrastructure setup, and documentation, is protected under copyright law. The copyright owner of HiDream AI is hidream.org.

  • You acknowledge that you do not own the underlying technology or intellectual property that makes up the HiDream AI service, and you agree to respect the intellectual property rights of hidream.org and any third parties.
  • While you retain ownership of your custom implementations and modifications, the core HiDream AI platform and templates remain the property of hidream.org.

Prohibited Activities

You agree not to engage in any of the following prohibited activities while using HiDream AI:

  • Unauthorized access to or distribution of our proprietary code and templates
  • Reselling or redistributing HiDream AI templates without authorization
  • Interfering with or disrupting the security or performance of the service
  • Using the service for any illegal or unauthorized purpose
  • Attempting to bypass any security features of the service

Acceptable Use Policy

HiDream AI is a generative AI image platform. To keep the Service safe for everyone, you must comply with our Acceptable Use Policy (the "AUP"), which forms part of these Terms. The AUP contains the full list of content restrictions; the categories below are examples only and are not exhaustive.

You may not use HiDream AI — directly, through our API, or via any automated system — to generate, upload, request, or distribute any of the following:

  • Sexually explicit, pornographic, or NSFW content, in any style (photorealistic, illustrated, anime, 3D, or otherwise);
  • Child Sexual Abuse Material (CSAM) or any sexualized depiction of minors, real or AI-generated — we have a zero-tolerance policy and will report to NCMEC and law enforcement;
  • Non-consensual intimate imagery or any sexualized depiction of a real identifiable person without verifiable consent;
  • Deepfakes or realistic impersonations of real people intended to deceive, defraud, harass, or defame;
  • Content that incites violence, or that targets individuals or groups with hate, harassment, or threats;
  • Content that provides meaningful instruction for creating weapons (including firearms, explosives, or chemical, biological, radiological, or nuclear weapons), controlled substances, or other illegal goods;
  • Content that infringes third-party intellectual-property, trademark, or publicity rights;
  • Fraudulent, deceptive, or scam material (counterfeit currency, fake IDs, phishing content, impersonation of institutions);
  • Prompts or techniques designed to bypass our safety, moderation, or content-filtering systems.

Prompt moderation is mandatory. Every prompt you submit is screened by automated moderation (including the Creem Moderation API) before generation. Prompts that are flagged or denied will not be generated. We may also screen uploaded images and generated outputs. Violations of the AUP or this section may result in refusal of service, removal of content, suspension or termination of your account, forfeiture of credits, and, where legally required, reporting to law enforcement or regulatory authorities.

Privacy and Data Collection

HiDream AI collects the following types of data:

  • Account Information: Information you provide when creating an account
  • Usage Details: Data related to your activity on our service
  • Device Information: Information about the device you use to access our service
  • Cookies: Data that helps us enhance your experience with our service
  • Payment and Billing Information: Data necessary to process payments

Pricing and Payments

  • Prices are displayed at checkout in the applicable currency and are subject to change with notice to users
  • You agree to pay all charges associated with your selected plan
  • Subscription plans renew automatically at the end of each billing period until you cancel them
  • Payments are processed by our third-party payment providers (Creem, Stripe, and Subotiz); we do not store your full card details

Cancellation Policy

You may cancel a subscription at any time, with no cancellation fee, through either of the following channels:

  1. In your account (self-service) — sign in and go to Settings → Billing → "Cancel Subscription". The cancellation is recorded as soon as you confirm it.
  2. By email — write to support@hidream.org from the email address registered on your account and ask us to cancel. We will action the request within 2 business days and confirm by email.

After you cancel, you keep access to your paid plan and any remaining credits until the end of the billing period you have already paid for, and no further charges will be taken. Cancelling on its own does not generate a refund of amounts already paid — refunds are governed by the section below.

Refund Policy

14-day refund window. You may request a refund within 14 days of a subscription charge or a one-time credit purchase, provided the credits attached to that charge are completely unused. Where the credits are entirely unused, we refund that charge in full. Once any of the credits from a charge have been used, that charge is no longer refundable, because the service has already been delivered. We do not issue partial or pro-rata refunds for partly used credits.

We will refund you at any time, including outside the 14-day window, where:

  • You were charged twice for the same order, or charged in error;
  • You were charged after you had already cancelled;
  • The charge was not authorised by you;
  • Credits were deducted for a generation that failed due to a fault on our side and was never delivered to you.

Refunds are not normally available where:

  • Any of the credits from that charge have been used, since the service has already been delivered;
  • Your account was suspended or terminated for breach of these Terms or of the Acceptable Use Policy;
  • The request is based on dissatisfaction with the artistic result of an image that was generated and delivered successfully, as generative AI output is inherently variable;
  • The charge is older than 14 days and none of the "any time" circumstances listed above apply.

How to request a refund. Email support@hidream.org from the email address registered on your account, stating the date and amount of the charge (or the order/receipt ID). We acknowledge every request within 2 business days and give you a decision within 5 business days. Approved refunds are returned to the original payment method and typically appear within 5–10 business days, depending on your bank or card issuer. You may also raise a refund request through the payment provider that processed your order (Creem, Stripe, or Subotiz) using the contact details on your receipt.

Your statutory rights. Nothing in this section limits any cancellation or refund right you have under mandatory consumer law, and where such law grants you a broader right than this policy, that law prevails. If you are a consumer in the EU, EEA, or the United Kingdom, you have a statutory 14-day right of withdrawal for digital services; by purchasing credits and asking us to make them available immediately, you request that we begin performance during that period and acknowledge that your right of withdrawal is lost once you have used the credits.

Termination

We reserve the right to terminate or suspend your access to the service at our sole discretion, without notice, for conduct that we believe violates these Terms or is harmful to other users of the service, us, or third parties.

Disclaimer of Warranties

The service is provided on an "as is" and "as available" basis. We make no warranties or representations about the accuracy, reliability, or availability of the service and disclaim all warranties to the fullest extent permitted by law.

Limitation of Liability

To the fullest extent permitted by law, hidream.org shall not be liable for any direct, indirect, incidental, special, consequential, or punitive damages arising from the use of or inability to use the service.

Indemnification

You agree to indemnify and hold harmless hidream.org, its affiliates, and their respective officers, directors, employees, and agents from any claims, damages, losses, liabilities, and expenses (including attorneys' fees) arising from your use of the service or violation of these Terms.

Governing Law and Dispute Resolution

These Terms shall be governed by and construed in accordance with the laws of the State of Delaware, United States of America, without regard to its conflict of law provisions. Any dispute arising out of or relating to these Terms or the service will be resolved through binding arbitration seated in Delaware, USA, conducted in English under the Commercial Arbitration Rules of the American Arbitration Association, except that either party may instead bring an individual claim in the small-claims court of Delaware. To the extent permitted by law, you and Image AI, LLC each waive any right to a jury trial and to participate in a class or representative action.

Changes to These Terms

We reserve the right to update or modify these Terms at any time. Changes will be effective immediately upon posting on our website. Your continued use of the service after any changes signifies your acceptance of the new terms.
